The Connecticut Appellate Court issued an opinion in his appeal saying that Judge Fuger was wrong in dismissing our claims of the suppression of exculpatory evidence and Vogt’s & criminal trial counsel’s ineffective assistance of counsel [failure to present an arson expert & failure to employ available evidence]. The case is being sent back to the trial court for a continuation of the trial but with a finding by the Appellate Court that we have established a prima facie case that the State suppressed exculpatory evidence and that there was ineffective assistance of counsel. http://truthinjustice.org/lapointe.pdf
